What is immigration court?

Immigration court (part of EOIR, within the Department of Justice) is where a judge decides whether a person can be deported and whether they qualify for relief. It is not the same as USCIS. The government is represented by an attorney; having your own attorney levels the process. You have the right to be represented at your own expense.

What we do in your court case

Court representation is not just "showing up." It includes:

Enter our appearance

We file Form EOIR-28 so the court and the government know you have counsel, and we track every date and deadline.

Respond to the charges

We analyze the Notice to Appear (NTA) and respond to the allegations, looking for defenses from the outset.

Identify your relief

We determine which defense you qualify for (cancellation, asylum, adjustment, waivers) and prepare the application and evidence.

Represent you at the hearing

We present your testimony and evidence before the judge and respond to the government attorney at the individual hearing.

The stages of your case

01

Notice to Appear (NTA)

The document that starts the case and brings it before the court.

02

Master Calendar hearing

A short preliminary hearing: you respond to charges and announce your defense.

03

Filing applications and evidence

Your relief application is prepared and filed within the judge's deadlines.

04

Individual merits hearing

The trial of your case, with testimony, evidence, and the judge's decision.

05

Decision and appeal options

If unfavorable, we evaluate appealing to the BIA within 30 days.

How long does it take?

It depends on your court and case type. Because of the large immigration-court backlog, many cases take several years. An attorney can estimate timelines for your specific court.
