What is removal of conditions?
When you get your green card through marriage and at the time of approval you have been married less than 2 years, immigration does not give you a 10-year permanent green card: they give you a 2-year 'conditional' one. This is a protection measure against fraudulent marriages. Before that conditional green card expires, you must file Form I-751 to 'remove the conditions' and obtain your normal 10-year permanent green card. If you do not file on time, you lose your residence and can enter removal proceedings. The I-751 is usually filed jointly with your spouse. But if your situation changed, there are options: divorce, abuse, or extreme hardship allow you to file alone with a waiver.

- Joint: if you are still married to the same person, you file with your spouse and together prove the marriage is bonafide.
- With divorce waiver: if you got divorced, you can file alone showing the marriage was genuine at the start.
- With abuse waiver: if your spouse abused you physically or emotionally, you can file alone without their signature or cooperation.
- With extreme hardship waiver: if deportation would cause exceptional hardship for you.
How the process works
Identify the filing window
You have 90 days before your green card expires to file I-751. Filing too early or too late causes problems.
Gather evidence of bonafide marriage
Joint bank accounts, joint rental or mortgage agreement, photos throughout the relationship, joint tax returns, family photos, communications, common children if applicable.
If filing with waiver, gather additional evidence
For divorce: divorce decree. For abuse: police reports, protection orders, medical or psychological evaluations, sworn declarations.
File the I-751
We file the complete package. Immigration sends a receipt that automatically extends your green card for 48 months while they process.
